There are TWO basic types of damages you can recover in your personal injury traffic accident case. They are what we call “special damages” and “general damages.”
- Special damages are those damages that you can pencil out on paper – these damages have fixed numbers. There are typically three types of special damages – Property Damage, Medical Damages and Loss of Earnings.
- The second kind of damages – General damages – are more esoteric. They are not hard numbers. These are the damages you can recover for the interference with your normal life, like the pain, inconvenience and distress caused by the accident and your injuries. These would be like your inability to function normally in your social life, family life and in your normal hobbies and activities that you did before the accident.
Both special and general damages are recoverable to you if you are injured in a personal injury accident. The amount of each type of damages depends on the facts of your case.
