Serious Injuries and Pursuing Compensation

Personal Injury
Serious injuries are covered under personal injury law. In many cases, victims can pursue compensation from the legally liable party.

Aside from natural causes and disease, serious and catastrophic injuries are typically the result of some form of accident. In the United States, car accidents are one of the leading causes of death for both adults and children alike. In fact, there are in excess of 40,000 car accident fatalities each and every year. The figure for the total number of crash victims is much higher, considering how many people survive; however, many of them sustain serious and life-threatening injuries from the collision.

Serious injuries pose a threat to a person’s health and safety if they do not seek medical attention. They can include: broken bones, lacerations, traumatic brain injuries, spinal cord injuries, internal injuries, road rash (as from a motorcycle accident), and eye injuries (which can lead to blindness), and much more.

Although a serious physical damage can be sustained nearly anywhere at any time, there are specific conditions or situations that tend to create harm more than others. For instance, people can sustain injuries at the workplace; they can become injured by a dangerous drug, or they can be hurt by a defective product. A small child can be viciously attacked by their neighbor’s Pit Bull, while a businessman can be injured in an elevator. On the other hand, a woman can fall down slippery and wet stairs in an office building, while a country club member can have their hair get caught in a pool drain. Truly, when it comes to serious and life-threatening injuries, when there is negligence involved, anything can go seriously wrong.

In today’s technological society, there are more opportunities to cause harm when people fail to maintain machinery. At the same time, when people operate large machines such as cars or boats in an unsafe or reckless manner, they can cause a significant amount of damage for those around them. It’s unfortunate to imagine that innocent bystanders would be harmed at the hands of negligent people, but it happens every day. These days, even pedestrians can be struck and seriously injured or killed by a passing motorist.

Serious injuries can leave the victim in an enormous amount of pain, and they can require a lengthy convalescence. They usually require expensive medical treatment, which can cost a fortune for the victim and their family. Fortunately, the law affords victims the right to pursue damages from the legally liable party. At times, it might be quite clear as to who is the legally responsible party in a claim, where other times liability might not be as simple to ascertain.

Whenever a person is seriously injured, their first mission must be to seek medical treatment. If they are physically able, they should make every attempt to document the scene and gather witness contact information. Take pictures of the scene, these days cell phones have the capability to document and sometimes record, if your phone has that feature, make sure you capture as much information as possible so it can be used at a later date to support your case.

Although you may expect a settlement offer with the insurance company, it is always recommended that you retain your own attorney. Insurance companies are only interested in the bottom line, which will not benefit you in any way. Once you have a lawyer involved, they will know how to document your case in such a manner that the actual value of your claim is submitted. The chances of you being taken advantage of by an unscrupulous insurance company are far lower if you have an attorney involved. Besides, in the days, weeks and months following a serious accident, your focus should be on healing and recovery, not battling an insurance company for what is rightfully yours. So please, contact a personal injury attorney without delay!
